Terms of service

These terms govern use of ERA Skills — the marketing site at eraskills.com and the application at app.eraskills.com — and the ERA Skills program. By creating an account, signing an order with us, or using the service, you agree to these terms. If you use the service on behalf of a club or other organization, you agree on its behalf and represent that you are authorized to do so.

The service

ERA Skills is a character development program for competitive youth sports clubs. It consists of a coaching curriculum, coach training, and web software through which coaches run assessments, athletes complete guided self-reflections and peer ratings, and parents view their own child's results. The program is designed for athletes aged 13–18, with under-13 participation possible only with verifiable parental consent.

Accounts and roles

Access to the application is role-based. Club administrators and directors manage their organization, coaches run assessments for their teams, athletes complete reflections and see only their own scores, and parents access their own child's results through a PIN issued by the coach or club administrator. You are responsible for keeping your credentials (including parent PINs) confidential and for the activity that occurs under your account. Tell us promptly at dane.berman@eraskills.com if you believe an account has been compromised.

Club responsibilities

As the customer, the club or organization is responsible for:

  • Obtaining parental consent before any athlete participates, including verifiable parental consent for athletes under 13, and keeping records of that consent.
  • Entering and maintaining accurate rosters, and removing athletes who leave the program.
  • Issuing parent PINs only after consent is in place, and only to the correct parent or guardian.
  • Ensuring its coaches and staff use the service in line with these terms.

Subscriptions and pilots

Paid plans are annual, per-organization subscriptions under the pricing agreed in your order. Fees are payable as invoiced, and payments may be processed by Stripe. We also offer one-team pilots at no charge: pilots are application-based, limited in scope and duration, and create no obligation for either side — a pilot club may walk away at the end, and we may decline or end a pilot at our discretion.

Acceptable use

Use of the service is subject to our Acceptable Use Policy, which is part of these terms. In short: peer feedback must be respectful, and you may not attempt to access data that your role does not permit you to see.

Intellectual property and your data

ERA Skills owns the platform, the curriculum, the training materials, and everything else that makes up the service, along with all associated intellectual property rights. Your club owns the data it and its users enter — rosters, reflections, ratings, comments, and evaluations. You grant us the license we need to host, process, and display that data in order to provide the service, and our handling of personal data is described in our Privacy Policy and, for organization customers, our Data Processing Addendum.

Disclaimers

The service is provided "as is" and "as available." We work to keep it reliable and useful, but we do not promise that it will be uninterrupted or error-free, and we do not guarantee any particular developmental outcome for any athlete. Coaching judgments remain the responsibility of the club and its coaches.

Limitation of liability

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, consequential, or punitive damages, and our total liability arising out of the service is limited to the amounts the club paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited.

Termination

Either party may terminate for material breach that remains uncured thirty days after written notice. We may suspend or terminate access for violations of the Acceptable Use Policy or to protect the safety of athletes and the integrity of the service. On termination, access ends and we handle club data as described in the Data Processing Addendum and our Privacy Policy.

Governing law

These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict of laws rules, and disputes will be resolved in the state or federal courts located in Nevada.

Changes to these terms

We may update these terms from time to time. If a change is material, we will notify club administrators through the platform or by email before it takes effect. Continued use of the service after the effective date means the updated terms apply.
